Art. 105:
Bei Amtsunfähigkeit des Präsidenten versehen die Vizepräsidenten der Reihe nach
das Amt. Minister- und Parlamentspräsident sind im Nachrückverfahren erst danach
an der Reihe. Eine Neuwahl des Präsidenten findert innert 60 Tagen (statt nach 3
Monaten) statt.

Maddə 105. Azərbaycan Respublikası Prezidenti vəzifədən getdikdə onun
səlahiyyətlərinin icrası
I. Azərbaycan Respublikasının Prezidenti vaxtından əvvəl vəzifədən getdikdə
üç ay ərzində 60 gün müddətində növbədənkənar Azərbaycan
Respublikasının Prezidenti seçkiləri keçirilir. Bu halda Azərbaycan
Respublikasının yeni Prezidenti seçilənədək Azərbaycan Respublikasının
Prezidenti səlahiyyətlərini Azərbaycan Respublikasının Baş naziri
Birinci vitse-prezidenti icra edir.
II. Bu müddət ərzində Azərbaycan Respublikası Prezidentinin səlahiyyətlərini
icra edən Azərbaycan Respublikasının Baş naziri Birinci
vitse-prezidenti istefa verdikdə, səhhətinə görə öz səlahiyyətlərini
icra etmək qabiliyyətini tamamilə itirdikdə Azərbaycan Respublikası
Prezidentinin səlahiyyətlərini Azərbaycan Respublikası Milli
Məclisinin sədri müəyyən etdiyi ardıcıllıqla Azərbaycan
Respublikasının vitse-prezidenti Birinci vitse-prezident statusu almış olur
və Azərbaycan Respublikası Prezidentinin səlahiyyətlərini icra edir.
III. Bu maddənin II hissəsində göstərilən səbəblərə görə Azərbaycan
Respublikası Prezidentinin səlahiyyətlərini Azərbaycan Respublikasının Birinci
vitse-prezidentinin icra etməsi mümkün olmadıqda, Azərbaycan Respublikası
Prezidentinin səlahiyyətlərini Azərbaycan Respublikasının Baş naziri icra
edir.
IV. Bu maddənin II hissəsində göstərilən səbəblərə görə Azərbaycan Respublikası
Prezidentinin səlahiyyətlərini Azərbaycan Respublikasının Baş nazirinin icra
etməsi mümkün olmadıqda, Azərbaycan Respublikası Prezidentinin səlahiyyətlərini
Azərbaycan Respublikası Milli Məclisinin sədri icra edir. Həmin səbəblərə görə
Azərbaycan Respublikası Prezidentinin səlahiyyətlərini Azərbaycan Respublikası
Milli Məclisinin sədrinin icra etməsi mümkün olmadıqda, Azərbaycan Respublikasının
Milli Məclisi Azərbaycan Respublikası Prezidentinin səlahiyyətlərinin başqa
vəzifəli şəxs tərəfindən icrası haqqında qərar qəbul edir.
23. Article 105.
The word "within three months" in the first sentence of Part I shall be
replaced by the word "within 60 days" and the words "Prime Minister" in the
second sentence of Part I shall be replaced by the words "First Vice-President".
The word "Prime Minister" in Part II shall be replaced by the word
"First Vice-President" and the word "powers by Speaker of the Milli Mejlis of
the Republic of Azerbaijan" shall be replaced by "Vice-President of the Republic
of Azerbaijan receives the status of First Vice-President in a specified
sequence and the powers of the President of the Republic of Azerbaijan."
23.3 Part III shall read as follows:
"III. Due to the reasons specified in Part II of this article, in case that
First Vice-President is unable to carry out the powers of the President of the
Republic of Azerbaijan, the powers of the President of the Republic of
Azerbaijan shall be carried out by Prime Minister of the Republic of
Azerbaijan."
23.4 Part IV shall be added as follows:
"IV. Due to the reasons specified in Part II of this article, in case that Prime
Minister is not able to carry out the powers of the President of the Republic
of Azerbaijan, the powers of the President of the Republic of Azerbaijan shall
be carried out by Speaker of the Milli Mejlis of the Republic of Azerbaijan. If
the Speaker of the Milli Mejlis of the Republic of Azerbaijan is unable to
fulfill the powers of the President of the Republic of Azerbaijan due to due
to aforementioned reasons, the Milli Mejlis of the Republic of Azerbaijan passed
a decision about the fulfillment of the powers of the President of the Republic
of Azerbaijan by other official."
