| Bemerkungen |
Im Gegensatz zur Georgischen SSR nimmt die Abchasische ASSR, d. h., ihre
nicht-georgische Bevölkerung, am Allunionsreferendum
der Sowjetunion teil. Da Georgien die UdSSR am 9.4.1991 verlässt, stellt sich
Abchasien auf den Standpunkt, wenn Georgien aus der UdSSR austreten könnte, gelte
das auch für Abchasien gegenüber Georgien. Nach mehreren Bürgerkriegen mit
Georgien will sich Abchasien 1999 formell für unabhängig erklären.
Zusammen mit den Präsidentenwahlen abgehalten. Präsident Ardzinba erlässt am 30.8.1999 ein Dekret, wonach gleichzeitig zwei Abstimmungen stattfinden. Die Verfassung ist der ersten Verfassung Abchasiens von 1925 nachempfunden. Die Mehrheit der Stimmberechtigten muss sich beteiligen, damit die Abstimmung gültig ist. Die Unabhängigkeitserklärung erfolgt am 12.10.1999. Abchasien wird nur von Russland und wenigen anderen Staaten als unabhängig anerkannt.
"THE DECREE OF THE PRESIDENT OF THE REPUBLIC OF ABKHAZIA "On Calling A National Referendum"
According to Article 2 of the Constitution of the Republic of Abkhazia and Articles 6 and 9 of the Law of the Republic of Abkhazia "About the National Referendum" and in order to realise the main principle of the organization of the state power authority in the Republic of Abkhazia, which defines the people as the only source of power and the bearer of sovereignty in the Republic of Abkhazia, I decree the following:
1) To call a national referendum on 3rd October 1999. - Do you approve of the Constitution of the Republic of Abkhazia, adopted by the Supreme Soviet of the Republic of Abkhazia on 26th November 1994, which declares Abkhazia a sovereign, democratic and law-abiding State, a subject of the international law? - According to Article 71 of the Constitution of the Republic of Abkhazia, the judges are irremovable. Given the current state of our legal system, do you deem it necessary to make an amendment to Article 71 of the Constitution of the Republic of Abkhazia, whereby its first part would read as follows: "Judges are elected for a period of 5 years. Judges are immune to criminal prosecution, are independent, and are subordinated only to the provisions of the Constitution and the Supreme Law of the Republic of Abkhazia"?
